Petitioner Nathaniel Atkins was convicted in September 1994 on two counts each of Criminal Sale and Criminal Possession of a Controlled Substance in the Third Degree in violation of New York Penal Law §§ 220.39[1] and 220.16[1]. On October 18, 1994, Atkins was sentenced to concurrent indeterminate prison terms of eleven to twenty-two years for the convictions for the sales of controlled substance...
