THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JERRY GAILLARD, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

Decided December 8, 1998.


This appeal was held in abeyance and the matter remanded to Supreme Court for determination of defendant's speedy trial motion (252 A.D.2d 357). On remand, the court found the People chargeable with 102 days' delay, well within the six-month statutory time limit imposed by CPL 30.30 (1) (a), and therefore denied the motion. Defendant has not challenged this decision.
