Plaintiff Upjohn Company ("Upjohn") brought this patent infringement action against MOVA Pharmaceutical Corp. ("MOVA") alleging that MOVA infringed Upjohn's United States Patent No. 4,916,163 ("the '163 patent") on a drug used to treat diabetes. A jury trial lasting nearly a month was conducted during November, 1998 and the jury returned a verdict for MOVA on all causes of action, including MOVA's counterclaim...
