In this action brought under the Air Carrier Access Act of 1986, 49 U.S.C. § 41705, Constance Price, on behalf of herself and her son (now deceased) seeks damages as a result of their being removed from a Comair flight owing to an odor emanating from bandaged tumors on Gregory Price's legs. Defendants Delta Airlines, Inc. ("Delta") and Comair, Inc. ("Comair") have moved for summary judgment on all counts...
