BACKGROUND

On July 17, 1996, Plaintiff Michael J. Coleman commenced this action against Southern Pacific Transportation Company, a Delaware corporation, in the Superior Court in Maricopa County alleging discrimination in violation of the Americans with Disabilities Act ("ADA"), 42 U.S.C. §§ 12101-12213.
