I. INTRODUCTION

Jonathan Thornton, a general contractor, entered into an oral contract to build a house for Steve and Jeannie Munn. Thornton maintains that he agreed to build the house for the cost of time and materials plus 15 percent with no cap on the total cost. The Munns contend that their agreement included a cap on total cost for the house. The cost escalated above this alleged cap, and the Munns refused...
