This is a second appeal from an action brought by Eugene and Vesna Shabinaw against Charles Brown, M.D. (Dr. Brown) alleging medical malpractice and lack of informed consent. After judgment was entered in favor of Dr. Brown upon a jury verdict of no liability, the district court granted a partial new trial on the issue of informed consent.
