David Scott Lively was convicted of grand theft, I.C. § 18-2403(1), -2407(b)(4), in April 1993. The district court imposed a unified ten-year sentence composed of a two-year minimum term of confinement followed by an eight-year indeterminate term. The court also retained jurisdiction for 180 days and, at the end of that period, placed Lively on probation. During the next four years, Lively violated probation three times.
