GUIDRY, Judge.

The defendant, Eual Howard Smith, Jr., was charged by bill of information with two counts of molestation of a juvenile, violations of La.R.S. 14:81.2, and pled not guilty. Prior to trial, the State decided to nolle prosequi count II. After a jury trial on count I, the defendant was convicted of attempted indecent behavior with a juvenile, a violation of La.R.S. 14:27 and La.R.S. 14:81, and was sentenced to three years imprisonment at hard labor.
