On December 14, 1993, Clarence Thomas Payton (Appellant) was severely and permanently injured in a workplace accident. At the time of the accident, Appellant was employed as a long wall maintenance foreman for Cyprus Cumberland Resources Group (Cyprus) at its Cumberland County mining site.
