Appellant Patrick B. Brown was accused of stealing an amplifier, compact-disc player, and rack-mount mixer from First United Methodist Church in Magnolia, Arkansas. Following a jury trial, he was found guilty of commercial burglary and theft of property, and was sentenced as a habitual offender to twenty-five years in the Arkansas Department of Correction.
