On December 18, 1991, while crossing Canal Street, plaintiff, Michael Molony, was struck by an automobile and thrown some distance onto the pavement. Plaintiff, then in his late 60s, had to be hospitalized from December 18, 1991 through January 22, 1992. He returned to the hospital for three days in February, 1992, to drain and remove a cystic mass on his left hip.
