Plaintiff, Rose Marie Falcone, filed this suit for damages for personal injury, alleging that a branch from a fallen tree in the backyard of her rented residence had fallen on her. Named as defendants in the suit were Camille Trapani, owner of the property, and Lafayette Insurance Company, who issued a policy of insurance to Ms. Trapani which covered the property.
