Jimmy Davis, Jr., was indicted for the capital offense of murder committed during a robbery in the first degree, or during an attempt thereof. Ala.Code 1975, § 13A-5-40(a)(2). The jury found him guilty and recommended, by a vote of 11-1, that the trial court sentence him to death. The trial court accepted this recommendation.
