VANCE, Justice.

Jason Wayne Tarvin was charged with the misdemeanor offense of driving while intoxicated. See Tex. Pen.Code Ann. § 49.04 (Vernon 1994 and Supp.1998). Tarvin filed a motion to suppress the evidence gathered after he was stopped, which the court granted.
