Patsy and Willis Graham brought suit against Tyler County (the County) pursuant to TEX. CIV. PRAC. & REM.CODE ANN. §§ 101.001-.109 (Vernon 1997 and Supp. 1999), commonly known as the Texas Tort Claims Act ("the Act"). They alleged a defect in a county road caused injury to Patsy.
