This case arises from an automobile accident which occurred on September 22, 1995, in Gonzales, Louisiana. The plaintiff/appellee, Mrs. Faye Young, was a passenger in the vehicle operated by her husband, Calvin Young, when they were rear-ended by a vehicle owned and operated by Gary Martinez.
