Appellant, Ervin Jerome Dickey, was indicted for the felony offense of murder. See TEX. PENAL CODE ANN. § 19.02 (Vernon 1994). After hearing the evidence, a jury found him guilty as charged in the indictment and assessed his punishment at confinement in the Institutional Division of the Texas Department of Criminal Justice for sixty years.
