FOWLER, Justice.

Appellant, Chad Herbert Gifford ("Gifford"), appeals from his conviction of one count of Aggravated Assault and one count of Deadly Conduct. See TEX.PENAL CODE ANN. §§ 22.02, 22.05 (Vernon 1994). The trial court, after hearing evidence, sentenced Gifford to five years imprisonment in the Texas Department of Criminal Justice, Institutional Division. Gifford appeals on five points of error.
