John Michael Davis (defendant) was originally charged by bill of information with fourth-offense driving while intoxicated (DWI), La. R.S. 14:98, predicated on four prior DWI convictions. Defendant entered an initial plea of not guilty. After the trial court denied defendant's motion to quash the original bill of information, the State recharged defendant by amended bill of information, which deleted one of four predicate DWI convictions alleged...
