Theodore Hoskins ("Mayor") appeals the judgment of ouster removing him from office as Mayor of the City of Berkeley1 for allegedly violating Article II, Section 2 of the Berkeley City Charter, which provides, in pertinent part, "A Councilman shall, during his/her term, hold no other elective public office...." The trial court held that Mayor violated this provision when, while serving as Councilman and Mayor, he was elected...
