Appellants, the City of Houston and Chief of Police Sam Nuchia ("the City"), appeal an order granting summary judgment which upheld a hearing examiner's award reinstating Appellee, James E. Tippy ("Tippy"), a discharged policeman. The City has assigned the following issues: 1) whether the examiner improperly applied existing law; or 2) exceeded his jurisdiction; and 3) what is the standard of review from an award of an examiner under Chapter 143...
