BENAVIDES, Circuit Judge:

This matter is before this three-judge district court on defendant's motion to dismiss, filed September 9, 1996, and plaintiff's motion for a preliminary injunction, filed November 14, 1997. For the reasons set forth below, defendant's motion to dismiss is DENIED, and plaintiff's motion for a preliminary injunction is GRANTED in part and DENIED in part. The State of Texas is hereby ENJOINED from enforcing the election law...
