Jerry Hammond appeals from his conviction for capital murder, a violation of § 13A-5-40(a)(2). On September 16, 1996, Hammond was tried, for the second time,1 before a jury on the charge that he murdered his uncle, James McNeil, during the commission of a robbery in the first degree.
