MEMORANDUM OPINION

WILLIAMS, District Judge.

Presently before the Court is Defendant's Motion to Dismiss for Lack of Subject Matter Jurisdiction. In ruling upon the motion, the Court has considered the motion, the opposition thereto, and the entire record. No hearing is deemed necessary. Local Rule 105.6 (D.Md.).
