HUDSON, Justice.

Appellant, Robert Vincent Bushnell, III, was convicted by a jury of the offense of robbery. His punishment was assessed at confinement in the Institutional Division of the Texas Department of Criminal Justice for a term of five years and a $150 fine. In one point of error, Bushnell contends the trial court erred in overruling his motion for instructed verdict. The State requests that the appeal be dismissed because Bushnell waived...
