Appellant, Rodney Wayne Green, was charged by indictment with capital murder, and found guilty by a jury of the lesser included offense of murder. See Tex.Penal Code Ann. §§ 19.02, 19.03 (Vernon 1994). Punishment was assessed at ninety-nine years confinement in the Texas Department of Criminal Justice, Institutional Division.
