THOMAS, Chief Justice.

Jerry Wayne Boyd was convicted, following a jury trial, of promotion of obscene material. The trial court imposed a sentence of one year's confinement, probated for one year, and a $500 fine on May 14, 1996. Appellant filed a timely motion for new trial; thus, the notice of appeal was due by August 12, 1996. See Tex.R.App. P. 26.2(a)(2). Appellant filed his notice of appeal on August 14, 1996.
