SHORES, Justice.
Anthony Boyd was convicted of intentional murder during a kidnapping, an offense made capital by § 13A-5-40(a)(1), Ala.Code 1975. By a vote of 10 to 2, the jury recommended the imposition of the death penalty; the trial court followed that recommendation, sentencing Boyd to death by electrocution. In a unanimous decision, the Court of Criminal Appeals affirmed Boyd's conviction and sentence. See Boyd v. State,
