VANCE, Justice.

Gwen David Westfall was charged by information with the misdemeanor offense of cruelty to animals. TEX. PEN.CODE ANN. § 42.09 (Vernon 1994 & Supp.1998). A bench trial was held, and the court returned a verdict of guilty. Punishment was assessed at confinement in jail for 30 days, probated for one year, and a fine of $2,000. Id. § 12.21 (Vernon 1994).
