TRAMEL v. BASS

No. 97-2136.

707 So.2d 847 (1998)

Thomas S. TRAMEL, III, Appellant/Cross-Appellee, v. Runette J. BASS, Appellee/Cross-Appellant.

District Court of Appeal of Florida, First District.

March 3, 1998.

Attorney(s) appearing for the Case

John W. Jolly, Jr., of Skelding, Labasky, Corry, Eastman, Hauser, Jolly & Metz, Tallahassee, for Appellant.

Mark A. Avera and Sharon H. Proctor of Avera & Avera, P.A., Gainesville, for Appellee.

BOOTH, Judge.

This cause is before us on appeal and cross-appeal from a final judgment entered by the circuit court. On appeal, Appellant/Cross-Appellee Thomas Tramel, as sheriff of Columbia County, contends that the trial court erred by refusing to allow consideration of apportionment of fault among sued co-defendants after the answer and affirmative defenses of Tramel were stricken and a default imposed. We affirm the issue on appeal without further comment.
