This is an appeal from an order granting a Rule 12(b)(6), Ala. R. Civ. P., motion to dismiss a complaint for failure to state a claim upon which relief could be granted.

In his complaint, James E. Reeves, Jr., averred that he had hired Larry Waites to represent his daughter in a criminal case pending in the circuit court and had paid Waites $10,000 for the representation. Waites failed to appear in court on three separate occasions, and his services...
