Presently before the Court are two actions commenced pursuant to 42 U.S.C. § 1983 by Plaintiff John Serbalik ("plaintiff" or "Serbalik") against his neighbors, Richard and Mary Gray (the "Grays"), and certain municipalities. The first action, 97-CV-1754 ("Serbalik I"), was brought against the Grays, David Hatin ("Hatin"), and the Town of Queensbury (the "Town"), and arises out of the testing of plaintiff...
