The appellant, Willie James Scott, Jr., was charged with conspiracy to distribute a controlled substance. During the guilty plea proceedings, the State moved to amend the indictment to charge unlawful distribution of a controlled substance, § 13A-12-211, Ala.Code 1975. The appellant agreed to the amendment and pled guilty to the unlawful distribution of cocaine. Pursuant to a negotiated plea agreement, the trial court sentenced him to imprisonment...
