I. Background

The dispute in this case arises out of the enforcement of a Massachusetts debarment statute. Section 25C(10) of chapter 152 of the Massachusetts General Laws states that

an employer who fails to provide insurance or self insurance as required by this chapter or knowingly misclassifies employees, to avoid higher premium rates, will be immediately debarred from bidding or participating...
