GONZALES, Judge.

In this appeal, Joseph Daniel Jarrell challenges a trial court judgment dismissing his petition to annul a probated testament based on the trial court's conclusion that Mr. Jarrell's action had been abandoned. In answer to the appeal, Floyd Stanley Mizell, the executor of the decedent's succession, contends that the trial court erred in concluding that Mr. Jarrell was married to the decedent.
