STOVER, Justice.

James Elliot Patterson was indicted for capital murder. Subsequently, a jury found Patterson guilty of killing Coy Roundtree during the course of a robbery, by hitting Roundtree with a piece of concrete. The State waived the death penalty, and the court sentenced Patterson to life imprisonment in the Institutional Division of the Texas Department of Criminal Justice.
