This lawsuit arises out of an alleged tort-feasor's attempt to obtain statutory damages under the Fair Debt Collection Practices Act, 15 U.S.C. § 1692, et seq. ("FDCPA"), against a company with subrogation rights of the insurance carrier of the party damaged by the alleged tortfeasor's actions.
