This is an appeal from a trial court judgment, granting a motion for summary judgment.

BACKGROUND

On January 14, 1982, appellee, Frank A. Genusa ("Genusa") sold a tract of immovable property ("the property"), located in East Baton Rouge Parish, to Robert L. Bynum ("decedent") by sale with mortgage for the sum of $18,500.00. In connection with the sale, decedent executed a promissory note, which was secured by a mortgage on the property...
