After a jury trial, appellants Gene and Nancy Tatum, were convicted of conspiracy in violation of 18 U.S.C. § 371. The conspiracy had two objects: (1) making a false statement for the purpose of influencing the Federal Deposit Insurance Corporation ("FDIC") in violation of 18 U.S.C. § 1007; and (2) defrauding and embezzling money from the FDIC in violation of 18 U.S.C. § 641.
