Jeff Allen Seneca was indicted by the Henry County grand jury on September 22, 1995, for trafficking in cocaine, a violation of § 13A-12-231, Ala.Code 1975. Seneca moved to dismiss the indictment, arguing that the state was estopped from prosecuting him.
