PER CURIAM.

James Ronald Swinney appeals the trial court's order dismissing his complaint with prejudice on res judicata grounds. We reverse.

In February of 1994, Swinney filed a second amended petition for writ of replevin against the City of Tampa Police Department, the City of Tampa, Detective Randy S.
