On May 22, 1996, Sheriff Wayne Spain of Dade County, Missouri, along with other officers, served a search warrant at the home of Joseph Albert Kriebs ("Appellant"). Sheriff Spain told Appellant that the officers had information that he was growing marijuana, to which Appellant replied either, "Yeah" or "Yes sir, I am."
