HILL, Justice (Assigned).

The State of Texas appeals the trial court's pre-trial rulings in the prosecution of Jim Vanderbilt for a murder committed over twenty years ago. Acting upon Vanderbilt's writ of habeas corpus, the United States Court of Appeals for the Fifth Circuit set aside his death sentence and remanded the case to the trial court for a new punishment hearing.
