On December 16, 1988, James B. Rogers pleaded guilty to one count of second-degree theft of property, and three counts of second-degree criminal possession of a forged instrument. He was sentenced to 4 concurrent terms of 17 years' imprisonment. Rogers did not file a direct appeal. Ten years later, in June 1998, Rogers filed a Rule 32, Ala.
