Ronald Frank Romero ("Romero"), an Indian, was arrested and indicted for aggravated assault on an Indian reservation against two non-Indians. The federal government asserted criminal jurisdiction under 18 U.S.C. § 1152.1 After receiving instructions from the court that the Government must prove the non-Indian status of the alleged victims, the jury returned a verdict of guilty.
