Kenneth R. Dewey challenges his conviction for rape in the third degree. Dewey contends that the trial court violated ER 404(b) by admitting evidence of a prior rape of a different woman, that the court improperly commented on the evidence in a jury instruction limiting the jury's consideration of the other incident, and that RCW 9.94A.120(4), commonly known as the "Three Strikes Law," is unconstitutional.
