WEISBERGER, Chief Justice.

This case comes before us on appeal by Nancy Volpe (Volpe) from a grant of summary judgment entered in Superior Court in favor of the defendant, Fleet National Bank (Fleet). Volpe seeks to recover money paid out by Fleet upon a check bearing her forged indorsement. The Superior Court granted summary judgment in favor of Fleet on the basis that the bank owed no duty to Volpe, a noncustomer, in negotiating the forged instrument...
