INTRODUCTION

The State, pursuant to Neb.Rev.Stat. § 29-2315.01 (Reissue 1995), has appealed the dismissal of the charge of carrying a concealed weapon against David N. Lewis. The charges against Lewis were dismissed when the Sarpy County Court determined that aluminum knuckles were not a deadly weapon per se under Neb.Rev.Stat. § 28-1202 (Reissue 1995) and that the State had not proved that Lewis used or intended to use the knuckles...
