MEMORANDUM OPINION AND ORDER

VAZQUEZ, District Judge.

THIS MATTER is before the Court on Defendant's Motion for Judgment of Acquittal, Pursuant to Rule 29(c), or, In the Alternative, Motion for New Trial [Doc. No. 73]. Following an evidentiary hearing, this Court previously granted Defendant's motion for a new trial for the reasons set forth in its Memorandum Opinion and Order of November 2, 1998 [Doc. No. 96].
